L’articolo indaga le sfide giuridiche poste dalla crescente diffusione dei sex toy, analizzando la loro classificazione quali beni di consumo o dispositivi medici, in un quadro normativo europeo privo di norme tese a garantirne la sicurezza. Atteso che tale vuoto regolatorio, unito alla discrezionalita dei produttori, espone gli utenti a rischi sanitari, si prospetta l’opportunita di adottare un approccio normativo maggiormente stringente, unito allo sviluppo di forme di educazione e sensibilizzazione dei consumatori sulle tematiche connesse alla salute e al benessere sessuale.
The article analyzes the legal challenges posed by the growing use of sex toy, investigating their classification as either consumer goods or medical devices within a European regulatory framework that lacks specific safety standards. Given that this regulatory gap, combined with manufacturers’ discretion, exposes users to health risks, the study proposes the adoption of a more stringent legal approach. this should be accompanied by the development of educational and awareness programs for consumers, with the aim of fostering greater awareness regarding sexual health and well being.
